Just about everywhere except the US either sells them unsubsidized (and
likely unlocked) or at least gives you the choice of buying them
unsubsidized or subsidized through two or more possible carriers. You CAN
buy an off-contract phone at full price, but the phone is still locked to
AT&T and since AT&T is the only US carrier there really is no point in not
taking advantage of the upgrade or full subsidized pricing.

As far as using on pre-paid / pay as you go / other carriers, software
unlocks are possible and were just ruled 'legal' but don't expect Apple or
AT&T to voluntarily unlock phones, even those 1st gen and 3G devices that
have satisfied all contract requirements.
